Terms of Service (TOS) for Artziii Education Program

1. Introduction

Welcome to Artziii! These Terms of Service (“Terms”) govern your use of the Artziii Education Program and any related services provided by Artziii LLC (“Company”, “we”, “us”, “our”). By using our services, you agree to be bound by these Terms.

2. Account Registration and Use

You must register for an account to access our services.
You are responsible for maintaining the confidentiality of your account and password.
You agree to provide accurate and complete information when registering.

3. Payment and Fees

The Artziii Education Program includes two subscription plans: Lite ($119.99 per user account annually) and Pro ($287.88 per user account annually).

Fees for non-payment are 25% of the subscription price per user, which is $29.99 for Lite and $71.97 for Pro per user account.

Payment is due within 30 days of the invoice date.
If payment is not received within 30 days plus a 7-day grace period, your account will be suspended, and you will be liable for the 25% non-payment fee. Legal action may be taken to recover the owed amount.

4. Termination and Suspension

We reserve the right to suspend or terminate your account if you violate these Terms.
Non-payment of fees will result in account suspension and potential legal action to recover the owed amount.

5. Intellectual Property

All content, including but not limited to the Artziii platform, Art Suite, Writing Suite, and Designer, is owned by Artziii LLC and is protected by intellectual property laws.

Customers retain ownership of any intellectual property they upload to the platform or create while using the platform, provided that all fees are paid in full [4].

6. Limitation of Liability

To the maximum extent permitted by law, Artziii LLC shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the use of our services.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of Oregon, without regard to its conflict of law principles.

8. Dispute Resolution

Any disputes arising out of or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website.
